Gift Card Terms and Conditions

Sea to Summit Store Gift Cards are issued by Sea to Summit North America, LLC. These terms and conditions (“Store Gift Card Terms”) apply to all Sea to Summit Store Gift Cards purchased, obtained, redeemed, or used by or for the benefit of consumers residing in the United States and Puerto Rico via the website seatosummit.com.  Sea to Summit only issues digital Store Gift Cards, which are sent to the email address of the Recipient as indicated by the Purchaser of a Sea to Summit Store Gift Card.  We recommend that You read these Store Gift Card Terms carefully before purchasing, using or redeeming a Sea to Summit Store Gift Card. Your purchase, acceptance, redemption or use of a Sea to Summit Store Gift Card constitutes Your agreement to follow and be bound by these Store Gift Card Terms.

  1. DEFINITIONS

“Goods” means eligible goods or products available for purchase on the seatosummit.com website. Sea to Summit Store Gift Cards are expressly excluded from the definition of Goods;

“Purchaser” means the purchaser of a Sea to Summit Store Gift Card;

“Recipient” means the email recipient designated by the Purchaser at the time of making the purchase of a Sea to Summit Store Gift Card or the person making a purchase with a Sea to Summit Store Gift Card on the seatosummit.com website;

“Sea to Summit”, “We”, “Our” and “Us” means Sea to Summit North America, LLC;

“Sea to Summit Store Gift Card” means a digital store Store Gift Card purchased from and issued by, Sea to Summit via the seatosummit.com website for use online at the seatosummit.com website;

“You” and “Your” means the Purchaser and/or the Recipient, as may be applicable.

  1. YOUR AGREEMENT TO THESE STORE GIFT CARD TERMS
  1. These Store Gift Card Terms apply to all Sea to Summit Store Gift Cards.
  2. By purchasing, accepting, using, or redeeming a Sea to Summit Store Gift Card, You agree to follow and be bound by these Store Gift Card Terms.
  3. Sea to Summit Store Gift Cards cannot be returned; resold; cancelled; transferred for value; redeemed for more than face value; used to purchase any other Store Gift Cards; used for any purchases other than purchase of Goods on the seatosummit.com website; used for any purchases outside of the United States and Puerto Rico; used for unauthorized sweepstakes, giveaways, advertising, promotional, or commercial purposes; or redeemed for cash or returned for a cash refund (expect to the extent required by law).
  4. You must not use any Sea to Summit Store Gift Card in a manner that is unlawful, fraudulent, misleading, deceptive, unfair or otherwise harmful to Sea to Summit, Our affiliates, Our customers, visitors to the seatosummit.com website, or any other person or entity.
  5. If You violate these Store Gift Card Terms, or We suspect or believe that a Sea to Summit Store Gift Card was obtained, used, or applied to a purchase of Goods fraudulently, unlawfully, or otherwise in violation of these Store Gift Card Terms, or use any Sea to Summit Store Gift Card in a manner that we suspect or believe is fraudulent, misleading, deceptive, unfair, or otherwise harmful to Sea to Summit, Our affiliates, or Our customers, We reserve the right, without notice to You, to cancel, hold, void, or refuse to accept such Sea to Summit Store Gift Cards without a refund, suspend or terminate accounts, suspend or terminate the ability to use Our services, cancel or limit orders, and bill alternative forms of payment.
  1. PURCHASING SEA TO SUMMIT STORE GIFT CARDS
  1. Sea to Summit Store Gift Cards can only be purchased online at the seatosummit.com website and only in denominations of $25, $50, $100, $150, or $200, expressed in U.S. Dollars. You cannot purchase a Sea to Summit Store Gift Card with any promotion or discount code. Sea to Summit Store Gift Cards are not available for purchase or redemption through any third party retailer.
  2. Sea to Summit Store Gift Cards cannot be reloaded or recharged, unless otherwise provided in these Store Gift Card Terms.
  3. After the Purchaser finalises the transaction for the purchase of a Sea to Summit Store Gift Card, the Recipient will receive an email with a unique code. A notification of delivery will also be sent to the Purchaser. To redeem the Sea to Summit Store Gift Card, You will need to enter the code at the checkout page on the seatosummit.com website. 
  4. It is the Purchaser’s responsibility to ensure that the email address of the Recipient is correct at the time of submitting the purchase of the Sea to Summit Store Gift Card. If You realize that the email address for the Recipient provided to Us at the time of the purchase of a Sea to Summit Card was incorrect, please contact us immediately at help@seatosummit.com in order to have the Sea to Summit Store Gift Card reissued to the correct email address of the Recipient. Sea to Summit will not be liable to the Purchaser, Recipient or any third party for any damages caused by incorrect information submitted to Us at the time of purchase of the Sea to Summit Store Gift Card.
  5. Once the transaction for the purchase of the Sea to Summit Store Gift Card is finalised, the Recipient will receive, and can immediately use, the Sea to Summit Store Gift Card.
  1. EXPIRATION AND FEES

Sea to Summit Store Gift Cards do not expire, and there are no fees associated with any Sea to Summit Store Gift Cards.

  1. USING THE STORE GIFT CARD
  1. Sea to Summit Store Gift Cards can be redeemed for purchases in U.S. Dollars of Goods at the seatosummit.com website. Sea to Summit Store Gift Cards cannot be used in any third party retail store, including to purchase Sea-to-Summit-branded goods sold by any such third party retail store.
  2. You can only redeem and use a Sea to Summit Store Gift Card to purchase Goods online at the seatosummit.com website in the United States and Puerto Rico.
  3. Except to the extent required by law, You cannot obtain any cash advance with Your Sea to Summit Store Gift Card; redeem Your Sea to Summit Store Gift Card for cash; receive any portion of the remaining Sea to Summit Store Gift Card value in cash or exchange the Sea to Summit Store Gift Card for another tender, cash, or discount.
  4. When You make a purchase with the Sea to Summit Store Gift Card, You are confirming that You agree to purchase the Goods at the stated purchase price and that You authorise Us to pay the purchase price by deducting the same amount from the Sea to Summit Store Gift Card. If the purchase exceeds the balance on Your Sea to Summit Store Gift Card, the remaining amount must be paid with another payment method.
  5. If the balance on a Store Gift Card is less than $5, the Store Gift Card holder can redeem it for cash.
  1. EXCHANGING GOODS PURCHASED WITH A SEA TO SUMMIT STORE GIFT CARD
  1. If You purchased Goods in whole or in part with a Sea to Summit Store Gift Card and wish to return the Goods, the return or exchange is subject to Sea to Summit’s Return Policy.
  2. If You are eligible for a refund (in whole or in part) for Goods purchased with a Sea to Summit Store Gift Card, the amount refunded will be credited on a new Sea to Summit Store Gift Card.
  1. CANCELLING A SEA TO SUMMIT STORE GIFT CARD; CORRECTING CLERICAL ERRORS
  1. Sea to Summit reserves the right to cancel and reissue any Sea to Summit Store Gift Card that has been compromised in any way without a prior notice to You.
  2. If there has been a clerical or accounting error, Sea to Summit reserves its rights to correct the balance on a Sea to Summit Store Gift Card.
  1. LOST OR STOLEN SEA TO SUMMIT STORE GIFT CARDS
  1. You are responsible for safeguarding your Sea to Summit Store Gift Card at all times from unauthorized use. Sea to Summit Store Gift Cards should be treated as cash and cannot be replaced or refunded if the balance on the Sea to Summit Store Gift Card was used or redeemed by unauthorized persons.  Sea to Summit will not be responsible for any damages in the event any Sea to Summit Store Gift Card is lost, stolen, destroyed, or used without Your permission.
  2. If You lose the Sea to Summit Store Gift Card or your system storing the Sea to Summit Store Gift Card has been compromised, please contact Sea to Summit immediately at help@seatosummit.com. We reserve the right to cancel Your Sea to Summit Store Gift Card and re-issue a new Sea to Summit Store Gift Card to You with the remaining balance that Our system has recorded as being the last balance held on Your Sea to Summit Store Gift Card.
  3. The person using the Sea to Summit Store Gift Card at the time of the purchase of Goods online from the seatosummit.com website shall be deemed to be the Recipient of that Sea to Summit Store Gift Card.

  1. LIMITATION OF LIABILITY

SEA TO SUMMIT STORE GIFT CARDS ARE PROVIDED ON AN 'AS IS' BASIS. WITHOUT LIMITING THE DISCLAIMER OF WARRANTIES CONTAINED IN SEA TO SUMMIT’S TERMS OF USE AND TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO SEA TO SUMMIT STORE GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT REPRESENT OR WARRANT THAT A SEA TO SUMMIT STORE GIFT CARD WILL ALWAYS BE ACCESSIBLE OR ACCEPTED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE AND OUR VENDORS SHALL NOT BE LIABLE TO ANY PERSON OR ENTITY FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE (WHETHER ACTUAL, CONSEQUENTIAL, PUNITIVE, SPECIAL OR OTHERWISE), INJURY, CLAIM OR LIABILITY OF ANY KIND OR CHARACTER WHATSOEVER BASED UPON OR RESULTING FROM THE SEA TO SUMMIT STORE GIFT CARDS OR USE OF SUCH STORE GIFT CARDS. IN THE EVENT THAT WE ARE FOUND LIABLE TO YOU AND TO THE FULLEST EXTENT PERMISSIBLE BY LAW, YOUR SOLE REMEDY WILL BE TO RECOVER ACTUAL AND DIRECT DAMAGES, WHICH SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR SEA TO SUMMIT STORE GIFT CARD.

  1. DISPUTE RESOLUTION
  1. Any dispute between you and Sea to Summit involving Sea to Summit Store Gift Cards will be governed in all respects by Colorado law, without regard to its or any other jurisdiction’s choice of law provisions, and not by the 1980 U.N. Convention on Contracts for the International Sale of Goods.
  2. Except where prohibited by applicable law, and without limitation to any statutory rights for consumers, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of or relating to Sea to Summit Store Gift Cards (including purchases made with such Store Gift Cards) shall be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in Boulder County, Colorado, USA.
  3. You consent to waive all defenses of “lack of personal jurisdiction” and “inconvenient forum” with respect to venue and jurisdiction in the state and federal courts of Boulder County, Colorado, USA.
  1. CHANGES TO THESE STORE GIFT CARD TERMS

Sea to Summit reserves the right to make changes to these Store Gift Card Terms, at any time without notice, from time to time at our sole discretion. All terms and conditions are applicable to the extent permitted by law. If any of these Store Gift Card Terms are deemed invalid, void, or for any reason unenforceable, that term and condition shall be deemed severable and will not affect the validity and enforceability of any remaining terms or conditions.
